Tell the US Department of Health and Human Services to protect LGBTQ Healthcare

The Trump-Pence Administration is trying to undermine the Health Care Rights Law, a lifesaving law that helps transgender people and others access the health care they need without discrimination from health care providers or insurers. On Friday May 24, 2019, the Department of Health and Human Services (HHS) proposed a new regulation that will jeopardize the health and well being of the LGBTQ community.

The proposed regulation focuses on Section 1557 of the Health Care Rights Law, a part of the Affordable Care Act that bans gender discrimination. The proposal would erase all reference to protections against discrimination on the basis of sexual orientation, sex stereotyping, and gender identity.

While they can’t change the law, this new regulation would confuse patients, providers, and insurers, and make it much harder for many LGBTQ folks, specifically transgender people, to access life-saving care. Our community already faces disturbing rates of health care discrimination including harassment and denials of care, and we often avoid doctor’s offices out of fear of discrimination.
